These Terms of Service ("Terms") govern your access to and use of the Akatare website, mobile applications, and related services (together, the "Platform"), operated by Akatare (registered legal name to be confirmed), a company registered in [Uganda] at P.O. Box 155208, Mukono, Uganda ("Akatare," "we," "us," or "our"). By creating an account, browsing, listing a product, or completing a purchase on Akatare, you ("you," "User") agree to be bound by these Terms and our Privacy Policy below.
If you do not agree, do not use the Platform.
You must be at least 18 years old, or the age of legal majority in your country, and have the legal capacity to enter binding contracts to use Akatare. By using the Platform, you represent that this is true. Accounts created on behalf of a business must be created by someone authorized to bind that business.
Akatare is a marketplace platform that connects independent buyers and sellers of agricultural products and related goods and services. Unless explicitly stated otherwise:
Akatare provides the marketplace infrastructure, escrow payment facility, messaging, and search/AI matching that make direct trade between buyers and sellers possible and safer — but the underlying trade (the sale of goods itself) is between Users.
Delivery, however, is coordinated and controlled by Akatare. For every order, Akatare determines the delivery arrangement: some orders are delivered by Akatare's own logistics network, and others are fulfilled with the seller acting under Akatare's coordination and instruction. In either case, Akatare — not the buyer and seller independently — sets the logistics partner, method, and timing of delivery.

Sellers are solely responsible for the accuracy of their listings and for fulfilling their obligations to buyers. Akatare may remove listings, suspend accounts, or withhold payouts where a seller has breached these Terms, misrepresented goods, or is subject of a substantiated buyer dispute.

The following may not be listed or transacted on Akatare, without limitation:
Additionally, Users may not: harass or defraud other Users; attempt to circumvent Akatare's escrow system by soliciting or making off-platform payment for a Platform-originated transaction; scrape, reverse-engineer, or interfere with the Platform; impersonate another person or business; or use the Platform for money laundering or any unlawful purpose.
We may remove content, suspend, or permanently terminate accounts that violate this section, and may report unlawful activity to relevant authorities.
If a delivered order doesn't match what was agreed, the buyer should open a dispute in-app before confirming receipt. Akatare will review the chat record, listing, and any evidence provided by both parties, and make a determination on escrow release in its reasonable discretion. Akatare's decision on the release of escrowed funds is final as between Akatare and the Users regarding that specific escrow transaction, without prejudice to either party's independent legal rights against the other.
Akatare is not obligated to arbitrate disputes beyond the escrow-release decision, and encourages Users to resolve disagreements about product quality, delivery, or performance directly, or through applicable local consumer protection mechanisms or courts.
Seller subscription tiers (Verified, Premium) and any paid boosts are billed as described at the point of purchase. Fees are generally non-refundable except where required by law or explicitly stated otherwise. See Pricing Plans for current terms.
The Akatare name, logo, website design, and platform software are the property of Akatare (registered legal name to be confirmed) and may not be used without written permission. Sellers retain ownership of the product photos and descriptions they upload, but grant Akatare a non-exclusive, royalty-free license to display, reproduce, and promote that content on the Platform and in Akatare marketing (including "Success Stories" and social media), unless the seller opts out where the Platform allows.
THE PLATFORM AND ALL LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKATARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, REGARDING THE PLATFORM AND ANY PRODUCT OR SERVICE LISTED ON IT. AKATARE DOES NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION OF THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) AKATARE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION BETWEEN USERS, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL; (B) AKATARE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (I) THE FEES YOU PAID TO AKATARE IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (II) [amount, e.g. UGX 100,000]; AND (C) AKATARE IS NOT LIABLE FOR THE ACTS, OMISSIONS, PRODUCT QUALITY, OR CONDUCT OF ANY BUYER OR SELLER, INCLUDING MISREPRESENTATION, OR FOR NON-DELIVERY OR LATE DELIVERY CAUSED BY A SELLER'S OR BUYER'S ACTS OR OMISSIONS.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless Akatare, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: your breach of these Terms; your listing or purchase of any product; your violation of any law; or your infringement of any third-party right.
We may suspend or terminate your access to the Platform, with or without notice, for violation of these Terms, suspected fraud, legal or regulatory requirement, or risk to other Users or the Platform. You may close your account at any time; outstanding escrow transactions will be resolved per Section 9 before final account closure.
We may update these Terms from time to time. Material changes will be notified via the Platform or email. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of [Uganda], without regard to conflict-of-law principles. Any dispute arising from these Terms or use of the Platform that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of [Uganda / specific venue], save for matters that applicable consumer protection law requires be resolved elsewhere.

This Privacy Policy explains what personal data Akatare collects, why, how it's used, and your rights over it, in connection with your use of the Platform.
We do not sell your personal data to third parties for their own marketing purposes.
We retain personal data for as long as your account is active and as needed to fulfil the purposes described above, including resolving disputes, enforcing our Terms, and complying with legal, accounting, or reporting obligations. Verification documents are retained only as long as necessary for verification and compliance purposes.
Depending on your country of residence, you may have the right to: access the personal data we hold about you; request correction of inaccurate data; request deletion of your data (subject to legal retention requirements); object to or restrict certain processing; and request a copy of your data in a portable format. To exercise these rights, contact sales@akatare.com. We will respond within the timeframe required by applicable law (e.g. Uganda's Data Protection and Privacy Act, 2019).
We use reasonable technical and organizational measures (encryption in transit, access controls, and secure payment processing via licensed partners) to protect your data. No system is completely secure, and we cannot guarantee absolute security of information transmitted to the Platform.
We use cookies and similar technologies to keep you logged in, remember preferences (like selected country/category filters), and understand how the Platform is used. You can control cookies through your browser settings; disabling some cookies may affect Platform functionality. See our Cookie Policy for details.
Akatare is not directed at children under 18. We do not knowingly collect personal data from anyone under 18. If we learn that we have, we will delete it.
As Akatare operates across multiple African countries, your data may be processed in a country other than where you reside. Where required, we take steps to ensure such transfers are protected consistent with applicable data protection law.
We may update this Privacy Policy from time to time. Material changes will be notified via the Platform or email, with the "Last updated" date revised accordingly.
